These terms are an agreement between you and Kyle McGahey ("we", "us") about your use of the Muggins app ("the app"). By downloading or using the app you accept them. If you do not agree, please do not use the app.
We grant you a personal, non-exclusive, non-transferable license to use the app on Apple devices that you own or control, for your own non-commercial use, as permitted by the App Store terms. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the app except where the law expressly permits it.
The app — including its design, artwork, sounds, and code — is owned by us and is protected by copyright and other intellectual-property laws. These terms give you the right to use the app; they do not transfer any ownership to you.
You agree to use the app only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access to related systems, or use it in any way that could harm us, other users, or third parties.
The app offers a small set of one-time in-app purchases: Remove Ads, individual board themes, and Unlock Everything, a bundle that includes ad removal and every paid theme in the app, including ones we add later. All purchases are non-consumable — buy once, own forever. Prices are shown in the App Store before you buy and may change over time. Each purchase is transacted by Apple through your App Store account, under Apple's payment terms. Purchases are tied to your Apple Account: "Restore purchases" in the menu brings them to your other devices signed into the same account. Purchases are not eligible for Family Sharing. The Unlock Everything bundle overlaps with the individual purchases — if you already own some of them, buying the bundle adds only what you don't yet own, and Apple does not automatically discount or refund the overlap. Refunds are available only through Apple under Apple's policies — we cannot issue refunds ourselves. If Apple refunds or revokes a purchase, the app removes what it unlocked (a refund of Unlock Everything removes everything the bundle granted).
Unless Remove Ads or Unlock Everything is owned, the app displays advertising served by Google. Ads are the advertisers' content, not ours, and we are not responsible for it. The app's handling of data in connection with ads and analytics is described in the Privacy Policy.
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the app will be uninterrupted or error-free. Muggins is a scoring aid — the pegs go where you put them, and we are not responsible for the outcome of your cribbage games or any wagers made on them.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for it (if anything) in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You can stop using the app at any time by deleting it. We may terminate this license if you materially breach these terms. Sections 2, 6, 7, and 10 survive termination.
We may update these terms as the app evolves. The current version is always available at this address, and the effective date above will change when the terms do. Continuing to use the app after a change means you accept the updated terms.
These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-law rules.
The app is distributed through Apple's App Store, and Apple's standard Licensed Application End User License Agreement also applies. These terms are an agreement between you and us, not with Apple: Apple is not a party to these terms, is not responsible for the app or its content, and has no obligation to provide support or maintenance for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. In the event of any conflict for App Store matters, Apple's terms control.
